EU citizen or Non-EU citizen
If you are a citizen of an EU country, then you do not need a visa to go and experience the beauty of Hungary. You can even search for a job and work in Hungary, you are not required to apply for a work permit if you are going to work.
However, if you are a Non-EU citizen, and want to take up employment in Hungary, then you will need to apply for a work permit. You need to be employed by a local Hungarian company with a labor contract. The residence permit for the purpose of gainful employment will be issued based on the validity and purposes of the employment contract.
If you want to stay for more than 90 days in country, then you need to apply for a residence permit. A temporary residence permit is valid for five (5) years and be renewed, if approved. If you have continuously lived in Hungary legally, then you can apply for a permanent residence permit which will allow you to live indefinitely in Hungary.
EU Blue Card
EU Blue Card is a combination of residence and work permit for highly skilled and highly qualified individuals who are not citizens of EU countries. The validity of an EU Blue Card is maximum of four (4) years. It can also be extended for another four (4) years. If you are granted with an EU Blue Card, you can only work for the employer and job title to which it was issued.
To apply for an EU Blue Card, you need to:
- Have a valid labor contract or job offer from local Hungarian employer
- Meet the minimum salary threshold in the member state
- Present documents proving that the national legal requirements are met (for regulated professions)
- Present documents proving that the relevant higher professional qualifications are met (for unregulated professionals)
- Have a valid passport or travel document
- Have a valid health insurance coverage
Working in Hungary
These are just some of the ways available to you to enable you start living Hungary but what about when you start working?
While Hungarian Labour Law may be strict in some places, it is relatively relaxed in others. It is a pre-requisite that to enter into an employment agreement, there must be an physical written copy in which the employer and employee have agreed upon the personal base wage as well as the position of the employee. A place of work is not required, however if the parties fail to set the primary place of work then the place where the employee regularly performs work will qualify as the primary place of work. There is a maximum probationary period of three months. In the case of a shorter probationary period, the parties may extend this period once, although the period can still not exceed three months.
As for the termination of an employment contract, there are three ways this can be done in Hungary:
- By Mutual Consent
- By Notice
- By Dismissal without Notice
Termination by mutual consent is exactly as it sounds and it is not regulated by Hungarian Labour Code provisions. Termination by mutual consent allows employer and employee to end the labour agreement freely but in agreement with the other party on conditions of termination. Termination by employee is when the employee or employer give notice to the other of intention to end the labour agreement. Employers must justify their terminations in writing and the reasons must be well-documented and significant. The period of notice is 30 days; however this is increased after the employment relationship is reached certain periods of length (increase of 15 days after 5 years, 20 days after 8 years, etc.) Dismissal without notice is also straight-forward. The employee or employer may end ther employment relationship immediately in case of gross negligence, commits a grave violation, or otherwise engages in conduct that would render the relationship impossible.
